Acceptance of Terms
By accessing or using Avec Vitesse (“we”, “us”, “our”, or the “Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. We may update these Terms from time to time. When we make material changes, we will notify you by email to the address on your account. Continued use of the Service after the notice period constitutes your acceptance of the updated Terms.
Description of Service
Avec Vitesse is an online TCF Canada exam preparation platform available at avecvitesse.ca. The Service includes listening and reading comprehension exercises, oral and written expression practice, full mock exam simulations, and access to study resources. The features available to you depend on your plan: a free trial, a paid subscription, or credits purchased individually. Current plan details, feature access, and pricing are described at avecvitesse.ca/pricing.
Eligibility and Account Registration
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Service. You must provide accurate and complete registration information and keep it current. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not create more than one account or share your account in a way that circumvents credit limits, access controls, or subscription restrictions.
Acceptable Use
You agree not to: (a) use automated tools, bots, or scripts to access or scrape the Service beyond its intended interfaces; (b) reverse-engineer, decompile, or attempt to extract source code or AI prompts from the Service; (c) circumvent rate limits, credit limits, or any technical access controls; (d) redistribute, sublicense, resell, or otherwise commercialise AI-generated feedback, scores, or other platform output; (e) represent AI-generated scores or feedback as official TCF Canada results or as proof of French proficiency for any immigration, academic, or professional purpose; or (f) use the Service for any unlawful purpose or in violation of any applicable law.
Free Trial
We may offer a time-limited free trial that includes a defined set of credits and features, as described at sign-up and on our pricing page at the time you register. Trial scope and included features may change for new sign-ups but will not be shortened for users currently in an active trial period. A trial does not obligate you to purchase a plan. When the trial ends, features that require credits or a subscription will become unavailable until you purchase.
Credits
Certain features — including oral practice sessions and mock exam simulations — require prepaid credits. Credits are consumed when a session is started or an exam is submitted, as described in the product interface. Credits do not expire while your account remains active. Credits are non-refundable once consumed.
Subscriptions and Billing
Subscription plans are billed in Canadian dollars and processed by Stripe. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. Cancellation takes effect at the end of the current billing period, and you retain access to your plan's features until then. To cancel, use the billing portal in your account settings or contact us at drue@avecvitesse.ca. Prices shown at checkout exclude applicable taxes, which are added at the time of purchase.
Refund Policy
Unused credits purchased within the last 14 days may be refunded upon request to drue@avecvitesse.ca, provided none of the credits in that specific purchase have been consumed. Credits that have been fully or partially consumed are non-refundable. Subscription fees for elapsed billing periods are non-refundable. Nothing in this section limits any rights you may have under applicable Canadian consumer protection legislation.
AI-Generated Content
Feedback, scores, and examiner-style interactions on this platform are generated by third-party AI models, including Anthropic Claude (written grading and feedback) and ElevenLabs (voice synthesis for oral practice sessions). This output is a study aid only. It does not constitute an official TCF Canada score, an IRCC evaluation, a Canadian Language Benchmark assessment, or any other form of certified language testing. Do not submit platform results as official proof of language proficiency.
Intellectual Property
All rights in the Service — including the platform interface, practice prompts, grading rubrics, branding, and content we provide — are owned by or licensed to Avec Vitesse. You receive a limited, personal, non-exclusive, non-transferable licence to use the Service for your own exam preparation. You may not copy, reproduce, or distribute our materials for resale, redistribution, or to train any third-party AI model without our prior written consent. You retain ownership of your own written responses and audio recordings submitted through the Service.
User Content
When you submit content — written answers, audio during oral sessions — you grant Avec Vitesse a limited, non-exclusive, revocable licence to process that content through our AI subprocessors solely to deliver grading, feedback, and session functionality. We do not claim ownership of your content and do not use it for any purpose beyond operating the Service. See our Privacy Policy for details on how response data is stored and deleted.
Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that AI-generated feedback will be accurate or complete, or that use of the Service will result in any particular exam score. Avec Vitesse is not affiliated with or endorsed by France Éducation International, IRCC, or any official TCF testing body.
Limitation of Liability
To the fullest extent permitted by law, Avec Vitesse is not liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of or inability to use the Service, including but not limited to loss of data, loss of revenue, or failure to achieve a target exam score or immigration outcome. Our total aggregate liability for all claims relating to the Service in any twelve-month period is limited to the total amount you paid us during that period, or CAD $25 if you have paid nothing. Some jurisdictions do not permit certain liability exclusions; in those jurisdictions our liability is limited to the minimum extent permitted by applicable law.
Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Governing Law and Disputes
These Terms are governed by the laws of British Columbia, Canada, without regard to its conflict-of-law rules. Before initiating any formal legal proceedings, you agree to provide written notice of your dispute to drue@avecvitesse.ca and allow 30 days for us to resolve it informally. Nothing in this clause prevents either party from seeking injunctive or other equitable relief in urgent circumstances where waiting 30 days would cause irreparable harm.
